Construction and trades immigration support

Connect project workforce needs with the right immigration pathway and the practical requirements of the role.

Who this may suit

Construction businesses, trade employers and regional project teams considering suitably skilled overseas workers.

Key considerations

  • Start with actual duties, project locations and employment arrangements. A job title alone is not enough to establish the occupation or visa pathway.
  • Check the worker's qualifications, experience and any required skills assessment alongside state or territory licensing.
  • Allow for nomination evidence, visa processing and any licensing steps before fixing a start date. Priority processing is not a guaranteed turnaround.

Match the pathway to the workforce need

The subclass 482 Skills in Demand visa may support temporary skilled recruitment; subclass 186 may provide an employer-nominated permanent route; and subclass 494 is a regional provisional option. Each has its own role, employer and worker requirements.

For a genuinely short-term, highly specialised and non-ongoing assignment, subclass 400 may warrant consideration. Structured occupational training has a different purpose and should be assessed against subclass 407 requirements. Where standard programmes cannot meet a demonstrated need, check whether an appropriate labour agreement is available.

Occupation, recruitment and employment evidence

Review the position description, reporting lines, work sites, proposed remuneration and who will actually employ the worker. Check any relevant occupation list and nomination criteria for the selected visa stream.

Labour market testing may be required. Its advertising and evidence rules depend on the visa stream and any applicable exemption or agreement. Plan this before nomination lodgement rather than assuming a general recruitment exercise is sufficient.

Skills assessment and trade licensing

Visa eligibility and permission to perform licensed work are separate checks. The appropriate skills-assessment route depends on the occupation and circumstances. Licensing is administered under the relevant state or territory requirements.

For certain licensed trades, the recognition process may involve an Offshore Technical Skills Record, a provisional licence, Australian-context gap training and supervised employment before full licensing. Confirm the applicable sequence with the assessing body and regulator. A trade licence may also have different conditions from a contractor's licence.

Current processing priorities for construction occupations

Ministerial Directions 121 and 122 commenced on 19 September 2026. They give priority to specified construction occupations within the visa applications they cover: Direction 121 covers subclass 482; Direction 122 includes subclasses 186 and 494.

The construction definition identifies ANZSCO groups and occupations, including construction trades and certain management, engineering, technical and plant-operation roles. It does not automatically cover every employee of a construction business or make every listed occupation eligible for every visa.

The directions govern processing order. Visa criteria, occupation-list requirements and licensing remain separate. Subclasses 400 and 407 are outside these directions.

How we can help

Discuss the proposed role, work locations and candidate with Ausdirect to identify the immigration requirements that need assessment alongside your recruitment and licensing plans.

Questions to consider

Does every construction role receive priority processing?

No. The occupation must fall within the direction's definition and the visa application must be within its scope. Priority does not establish eligibility or guarantee a visa.

Does an overseas trade qualification allow immediate licensed work?

Check the relevant Australian licensing requirements. Assessment, gap training, supervision or additional evidence may be needed before the person can perform the proposed work.

Can a short project automatically use subclass 400?

No. The work must meet that visa's requirements, including being highly specialised and non-ongoing. Project duration is only one part of the assessment.
