Labour agreements

Assess agreement-based options when a genuine workforce need cannot be met through standard programmes.

Who this may suit

Employers considering an industry arrangement, a regional DAMA or a company-specific request for overseas recruitment.

Key considerations

  • Begin by checking the standard skilled visa programmes and whether an existing industry or regional arrangement covers the workforce need.
  • An agreement can support one or more of the subclass 482, 186 and 494 visa programmes. Its actual terms determine which routes and occupations are available.
  • A concession must be available under the applicable agreement. An agreement, endorsement or nomination does not guarantee the worker a visa.

Industry labour agreements

Industry agreements have terms negotiated for a particular industry, including the occupations and conditions available to participating employers. An employer must fit the relevant framework and meet its access requirements.

Check the current industry template before building a recruitment plan. Its conditions may differ by occupation, location or visa subclass. For example, the Aged Care Industry Labour Agreement has specific direct-care occupations and access conditions; it does not cover every healthcare or disability employer.

Designated Area Migration Agreements (DAMA)

A DAMA has a regional head agreement and individual labour agreements for endorsed employers. The relevant Designated Area Representative (DAR) manages employer endorsement under the local framework.

The employer needs DAR endorsement before lodging its labour-agreement request with Home Affairs. Check the workplace location, occupation, available concessions and any local requirements with that representative. A worker cannot treat a DAMA as an independently available visa.

Company Specific labour agreements

A company-specific request requires a substantiated workforce need that is not appropriately addressed by standard skilled programmes or a relevant existing agreement. Home Affairs examines the business case rather than approving access simply because an employer prefers different conditions.

Evidence can include recruitment efforts, detailed duties, financial viability, workforce planning and stakeholder consultation. Each requested concession needs justification. Australian employment protections and applicable licensing requirements still need to be addressed.

From workforce need to applications

The agreement stage comes before the nominations and individual visa applications made under it. The approved agreement sets out the occupations, available visa pathways and the conditions the employer must follow.

  • Define the roles, locations, recruitment history and expected workforce need.
  • Compare standard options with the relevant industry, DAMA or company-specific framework.
  • Complete the applicable endorsement, consultation and supporting-evidence steps.
  • If an agreement is approved, prepare nominations and visa applications against its terms.
  • Monitor agreement conditions and sponsorship obligations throughout its operation.

Which visa pathways may be available?

Subclass 482 provides temporary skilled employment through its Labour Agreement stream. Subclass 186 provides a permanent employer-nominated route where the agreement and visa requirements permit it. Subclass 494 provides a regional provisional route. Availability and any transition to permanent residence must be checked against the particular agreement and current visa criteria.

How we can help

Discuss your workforce need with Ausdirect before choosing an agreement type. The initial review can identify which framework and supporting evidence need closer examination.

Questions to consider

Is a DAMA itself a visa?

No. It is an agreement framework. An endorsed employer must obtain the relevant labour agreement, and the nomination and visa requirements still apply.

Can we assume that age, English or salary concessions will apply?

No. Available concessions depend on the agreement, occupation and visa. A company-specific request must justify each concession, and approval is not assured.

Does a labour agreement automatically provide permanent residence?

No. Check whether the agreement provides the relevant permanent pathway and whether the worker meets its conditions and the visa requirements.
