TWO FRAMEWORKS. FOUR PRACTICAL GUIDES.
SBS
The skilled-employment sponsor framework.
TAS
The sponsor framework for relevant training and temporary activities.
Businesses and organisations preparing to sponsor an overseas worker, trainee or temporary-activity participant, and existing sponsors reviewing their arrangements.
Standard Business Sponsorship is the usual sponsor-approval framework for the standard subclass 482 and subclass 494 employer-sponsored routes. The business, position and worker must each satisfy the requirements relevant to the selected pathway.
Preparation starts with the correct legal entity, evidence that the business is lawfully operating, and its recruitment and compliance history. Australian businesses must address the local-labour and non-discriminatory recruitment requirements. Overseas businesses have additional purpose-specific requirements.
A Standard Business Sponsor may seek accreditation by demonstrating the characteristics of an applicable Home Affairs category. These can involve the organisation's workforce, sponsorship history, employment arrangements and compliance record.
Accredited sponsors retain the same sponsorship obligations as other Standard Business Sponsors. Accreditation can be revoked if the required characteristics are no longer met. Processing arrangements must be checked against the current visa rules and directions; accredited status does not guarantee approval or a decision date.
Temporary Activities Sponsorship is relevant to subclass 407 training and to subclass 408 activities where sponsorship is required. It also has a role in the subclass 403 Pacific Australia Labour Mobility stream, which has its own programme requirements.
The Temporary Activities Sponsor guide covers organisational setup and the separate obligations that apply to this sponsorship type.
For Standard Business Sponsors, review employment terms, the nominated occupation, records, reportable changes and the rules on employer-paid costs. Required travel-cost payments and cooperation with monitoring may also apply. The exact duties and their duration depend on the obligation and circumstances.
A practical internal checklist should identify who maintains the records, reviews changes and tracks reporting deadlines. Revisit it before a restructure, a change of duties or an employee's departure.
Discuss the proposed role or activity with Ausdirect, including which sponsorship framework needs examination and what application or compliance assistance you require.
Subclass 407 uses Temporary Activities Sponsorship. Check that the organisation has the appropriate approval and that the required training nomination has been approved before the visa application.
No. Accredited sponsors have the same sponsorship obligations as Standard Business Sponsors and must continue to meet the conditions relevant to their accredited status.
Labour agreements provide a separate agreement-based route for demonstrated workforce needs that standard programmes cannot meet. The agreement determines the available occupations, visa pathways and any concessions. See the Labour agreements guide.
Have the legal entity details, current sponsorship approval if any, proposed role or activity, location and relevant dates ready for an initial discussion.
