Skilled Independent visa · subclass 189 Hong Kong stream

A permanent residence pathway built around your qualifying visa and established home in Australia.

Review note · Current permanent visa · Hong Kong stream · Sources checked 2026-10-16. Professional approval for publication pending.

Who this may suit

This stream is for eligible Hong Kong or British National (Overseas) passport holders with a qualifying Australian visa and residence history. It can allow permanent residence anywhere in Australia. Establish the exact visa and residence timelines before deciding when to apply.

Key considerations

  • This is a separate stream with its own rules; the Points-tested checklist does not apply.
  • The ordinary four-year visa-holding test and four-year usual-residence test are separate.
  • Check individual grant dates, visa conditions, absences and family circumstances before lodging.

A separate route from the Points-tested stream

The Hong Kong stream does not use a SkillSelect EOI, points-test invitation, nominated occupation or points-tested skills assessment. The Points-tested stream’s under-45 invitation rule does not apply to this application. Your earlier temporary visa had its own requirements; those should not be confused with the permanent Hong Kong-stream criteria.

The focus here is your passport, qualifying visa, Australian residence and compliance history. A Hong Kong connection or four years spent in Australia does not, by itself, establish eligibility.

Check the passport and the qualifying visa

At application, the main applicant must hold a Hong Kong or British National (Overseas) passport and an eligible visa granted on primary criteria. The eligible visa classes are 457, 482, including Temporary Skill Shortage or Skills in Demand, and 485.

The ordinary rule requires at least four years holding that same eligible visa. Separate grants cannot simply be added together, even within one subclass. A visa held as someone else’s dependant does not meet the primary-holder requirement for your own main application. Historical exceptions need separate checking.

Why the grant date and visa duration matter

For the ordinary cohort granted on or after 9 July 2020, the qualifying visa must permit the relevant travel, entry and stay for five years from when it took effect. The earlier cohort used permissions ending no later than 8 July 2025. That date is now historical, not a future application deadline.

Transitional provisions include a specific exception to the four-year holding requirement for certain subclass 457 grants on or after 9 July 2020. They do not remove the usual-residence test. Have older grants, extensions and pending cases checked individually; an old article cannot establish that you hold an eligible visa today.

Four years of usual residence is a separate test

You must have been usually resident in Australia continuously for at least four years immediately before applying. Holding a visa for four years is not a substitute for this residence history. Assess where your home actually was, alongside your intention to make Australia your home.

Temporary trips, such as holidays or short work assignments, can be consistent with usual residence. The question is whether Australia remained your genuine home. There is no universal safe allowance of days abroad stated in this guidance; avoid importing citizenship absence limits.

  • Create a dated address and travel timeline, explaining each substantial absence.
  • Connect the timeline to housing records, work or study activity and everyday household arrangements.
  • Australian movement records can confirm arrival and departure dates. They do not, alone, prove where your usual home was.

English, health, character and visa compliance

For applicants who were 18 or over at application, check functional-English evidence or whether an English-related second instalment applies; specified exemptions exist. Accepted evidence can include specified passports, qualifying English-medium education or approved tests. Test-date rules and validity periods matter; do not reuse a score table without checking it.

Health and character requirements apply, including to relevant non-migrating family members. Disclose criminal history accurately and obtain the police evidence required for your circumstances. Significant health issues need individual assessment rather than an assumption of automatic refusal or automatic waiver.

Review compliance with the eligible visa and any subsequent bridging visa. Check work and other conditions in the grant notices and VEVO, and raise any possible breach before lodging. Government debts, previous refusals or cancellations and Australian-values requirements can also affect the application.

Plan the family application together

Eligible family-unit members can be included when lodging or added before decision. A partner needs relationship evidence; children need the applicable relationship, dependency and parental-responsibility evidence. Notify Home Affairs promptly of a child born while the application is pending.

The main applicant’s passport and four-year primary-visa requirements are not a checklist every accompanying family member must independently satisfy. Adult children and people whose family-unit status has changed need a closer review of their own visa history and the applicable family rules. Do not assume everyone can simply be added after the main visa is granted.

Prepare a connected evidence file

Organise records around the issues Home Affairs must decide. A coherent chronology makes gaps easier to identify before lodgement. These are preparation prompts; the current application checklist and individual circumstances determine the documents required.

  • Identity: current and relevant previous passports, name-change records and consistent personal details.
  • Visa history: grant notices, extensions, evidence of primary-holder status and current VEVO details.
  • Residence: leases or ownership records, household bills and other dated material supporting the address timeline.
  • Travel: movements and explanations supported by records showing where your home remained during absences.
  • Family and English: relationship, dependency, parental-consent and accepted English evidence for the people included.
  • Health and character: required examinations, police records and relevant disclosures. Provide the required English translations of non-English documents.

Application, location and lawful status

Apply online through ImmiAccount once the requirements are met. Attach the supporting material, pay the applicable initial charge and keep the transaction reference and a complete copy. There is no SkillSelect invitation to wait for in this stream.

You can be inside or outside Australia at application and decision, but not in immigration clearance. Being offshore does not remove the immediately preceding usual-residence requirement. If applying onshore, check lawful status and any bridging-visa grant separately; preparing an application creates no permission to remain.

While waiting, monitor ImmiAccount requests, correct mistakes and report relevant changes. Before overseas travel, confirm that your current visa permits return. Do not assume a bridging visa carries travel rights.

Costs, processing and life after grant

Use the current Visa Pricing Estimator for the Hong Kong stream and your family composition. Budget separately for any English-related second instalment, health checks, police records, translations and professional fees. Obtain a current written breakdown rather than relying on a historical advertised price.

The processing-time guide reports recently decided applications; it does not promise your decision date. Keep major employment, housing and travel commitments proportionate to the stage reached.

Grant gives permanent residence with an initial five-year travel facility. Check any first-entry deadline and future return rights. Staying indefinitely in Australia and returning after overseas travel are separate matters; an expired travel facility may require a Resident Return visa. Citizenship is a separate application with its own requirements.

Compare the relevant Hong Kong and legacy pathways

The subclass 191 Hong Kong stream has a separate regional route: ordinarily three years holding a qualifying visa, three years of usual residence in a designated regional area immediately before application, and regional-location requirements for work or study undertaken during that period. It is distinct from the 191 Regional Provisional stream for 491/494 holders. Compare the actual location history before choosing.

The 189 New Zealand stream closed to new primary applications on 1 July 2023. It remains relevant to existing cases and historical information, rather than a third open choice for a new 189 application.

How we can help

Ausdirect can review your passport and grant history, map the visa and residence timelines, identify evidence gaps and compare the 189 and 191 Hong Kong pathways. Assistance with preparation and lodgement can then be agreed around your circumstances. Home Affairs determines eligibility and the visa outcome.

Questions to consider

Can I combine two years on a 485 with two years on a 482?

Not to satisfy the ordinary four-year qualifying-visa holding rule. It concerns the same eligible visa, rather than cumulative time across separate grants. Review the grant history and any specific transitional provision before making a plan.

Does a holiday overseas break the residence period?

Not necessarily. The official explanation allows some temporary absences where Australia remains your genuine home. Duration, purpose and the wider facts matter. Prepare the evidence instead of relying on a fixed annual travel allowance.

Do I need 65 points or an invitation?

No. Those belong to the Points-tested stream. A Hong Kong-stream application is assessed against its own passport, visa, residence and other criteria, and is lodged through ImmiAccount.

Can I apply just because I have lived in Australia for four years?

No. The residence period and qualifying-visa holding period are separate, and the other criteria still apply. Build both timelines before choosing a lodgement date.

Can the 191 Hong Kong stream be relevant sooner?

It may be relevant where the qualifying-visa and regional residence, work and study requirements are met. Its three-year framework cannot be assumed from a regional postcode alone. Assess the complete history against the 191 Hong Kong stream requirements. The Regional Provisional stream for 491/494 holders has different requirements.
