General Overview for 491 Visa Tasmania

In order to apply for the Tasmania 491 visa, you will need to be nominated by the Tasmania Government or an eligible family member. This provisional visa will allow you and your dependant family to live, work and study in the regional Tasmania for 5 years. You will be expected to live in the regional Tasmania for at least 3 years before satisfying the requirement for applying for permanent residency.

491 Visa Tasmania Application Process

Step 2 – EOI for 491 Visa Tasmania

You must submit a valid EOI (Expression of Interest) for Tasmania 491 visa and ensure the information in the EOI is accurate and up to date.

Step 3 – State Nomination Application for 491 Visa Tasmania

Submit the official nomination application to Tasmania.

Step 4 – Apply for 491 Visa

Once your state nomination application has been approved, you will receive the approval letter and also the invitation to make an application for the 491 skilled visa.

Step 5 – Respond to any RFI requests by the Immigration

When Department of Home Affairs assess your visa application, they may send a number of RFI (Request for Further Information) to ask for more information for verification before making a decision on your visa application. It is critical that you fully understand the 491 visa requirement before you lodge the application.

491 Visa Requirements – Federal Government

You and your dependant family must satisfy the Department of Home Affairs requirements:

    • must be under age 45 when being nominated
    • obtain a full skills assessment for the skilled occupation that you have nominated
    • have competent level of English Language
    • scored at least 65 points or higher on the skilled migration point test

Available Nomination Streams and Requirements for 491 Visa Tasmania – State Government

There are 5 available nomination categories for Tasmania 491 visa. We will provide brief introduction to these caterogiess in this section.

Tasmanian Graduate Category

If you completed your study in Tasmania, you may consider apply for the State nomination via this pathway.

If you commenced your last course of study in Tasmania before 30 June 2021, you need to fulfill the following requirements:

    • You must have completed and graduated from a CRICOS registered tertiary institution in Tasmania.
    • You must have lived in Tasmania for at least 1 year and during your period of study prior to applying for state nomination.
    • You and your dependents must currently be living in Tasmania and can provide evidence of your genuine ongoing commitment to remain in Tasmania.
    • If you are not currently in skilled employment, you must provide a career plan that explains how your studies have increased your ability to find skilled work in Tasmania.

If you commenced your last course of study in Tasmania commenced after 30 June 2021, you need to fulfill the following requirements:

    • You must have completed a course of study and obtained a letter of completion from a tertiary institution in Tasmania registered on the CRICOS.
    • Your course of study must be listed on CRICOS for at least 40 weeks and must have been completed full time and on-site in Tasmania. You must have lived in Tasmania for least one year from the commencement of your course and for the duration of your studies.
    • You and your dependents must be currently living in Tasmania and can provide evidence of your genuine ongoing commitment to remain in Tasmania.
    • If you are not currently in skilled employment you must provide a career plan that explains how your studies have increased your ability to find skilled work in Tasmania.
    • Your study does not need to be related to your nominated occupation, however a relevant skills assessment will be highly regarded
    • If you held a Student visa when you completed your last course of study in Tasmania, the study must be:
    • If you held a visa that was NOT a Student visa at the time you completed your last course of study in Tasmania, the study MUST be directly related to a Priority Industry Training and Workforce Development Area (current at the time you commenced study) at the minimum qualification level specified for that area.

Working in Tasmania Category

If you have been working in Tasmania for more than 6 months, you may be eligible to apply for State nomination via this category.

If your employment commenced after 29 January 2021, the following requirements apply to you:

    • You must have been working in Tasmania for 6 months immediately prior to your application for state nomination. You do not have to be working in your nominated occupation. However, if you have a skills assessment and related employment in an occupation listed on the Tasmanian Skilled Occupations List (TSOL), you may be eligible for nomination after 3 months of employment.
    • You must have a full-time job or 2 part-time jobs with at least 35 working hours per week.
    • You and your dependents must be currently living in Tasmania and can provide evidence of your genuine ongoing commitment to remain in Tasmania.
    • Your employer must have a well-established business that has been actively operating in Tasmania for the past 12 months.
    • There must be a genuine, ongoing need for your position within the business.
    • Employment in positions classified at ANZSCO skill level 4 or 5 will not be eligible for the purposes of state nomination. However, under some circumstances, it is still possible to obtain state nomination. Please contact our team if this applies to you.

If your employment commenced before 29 January 2021, the following requirements apply to you:

    • You must have been working in Tasmania for 6 months immediately prior to your application for state nomination. You do not have to be working in your nominated occupation.
    • You must have a full-time job or 2 part-time jobs with at least 35 working hours per week.
    • You and your dependents must be currently living in Tasmania and can provide evidence of your genuine ongoing commitment to remain in Tasmania.
    • Your employer must have a well-established business that has been actively operating in Tasmania for the past 12 months.
    • There must be a genuine, ongoing need for your position within the business.
    • If your employment is for a position at ANZSCO skill level 4 or 5, your employer must also provide evidence that no local person was able to fill the position.

Overseas Applicant TSOL Category

If you are currently residing offshore, you could seek nomination via this pathway.

For the TSOL stream, you can only apply for nomination via this stream when you are invited by Migration Tasmania. If your occupation is on the Tasmanian Skilled Occupation List (TSOL) and you meet all the requirements, you can submit an EOI on SkillSelect and choose Tasmania as your state of interest. Migration Tasmania will periodically review EOIs and invite promising candidates to apply for nomination via SkillSelect. If you receive an invitation for nomination, you will need to complete application for nomination on the Government website within 60 days.

The criteria for this stream is as following:

    • Your occupation SHOULD be on the Tasmanian Skilled Occupation List (TSOL). However, if your occupation is not on the list, you may still submit an EOI for Tasmanion nomination, but there is no guarantee you will be receive an invitation.
    • You, or any of your dependents, have not lived in any of the Australian state or territory within the last 12 months.
    • You have satisfied the English requirements specified on the TSOL for your nominated occupation, unless you hold a passport of the following countries, the UK, Ireland, the USA, Canada or New Zealand.
    • You have met the other requirements and notes listed on the TSOL for your nominated occupation.
    • You have sufficient funds to support your migration and settlement in Tasmania for at least the first 6 months.
    • You have researched the Tasmanian labour market and can prove that there are sufficient employment opportunities in Tasmania. However, if your nominated occupation is listed as “High Demand” on the TSOL and you meet the specified requirements, you will not need to provide employability evidence.

Overseas Applicant Job Offer Category

If you are currently residing offshore and have successfully obtained a job offer based in Tasmania in your nominated occupation, you may seek nomination via this pathway.

You will need to satisfy the following criteria:

    • You have a formal job offer that is based in Tasmania in your nominated occupation.
    • If your job offer is on the TSOL, you must obtain a Skills Assessment with positive outcome and meet the English and other requirements for the nominated occupation on the TSOL.
    • You, or any of your dependents, have not lived in any of the Australian state or territory within the last 12 months.
    • Your employer must have a well-established business that has been actively operating in Tasmania for the last 12 months.
    • Your wages and conditions must be the same as those would be applied to an Australian citizen or PR.
    • There is a genuine and ongoing need for your position within the business and the capacity for the business to sustain your employment

Family in Tasmania Category

If you are currently residing outside of Tasmania and have an immediate family member who meets the following requirements, you may seek nomination via this category.

    • They have been an Australian PR or citizen for at least 12 months prior to lodging your application.
    • They are currently living in Tasmania for at least 12 months.
    • They are either your parent, brother, sister, child, aunt, uncle, or grandparent. Please note, relationships by marriage are not acceptable.
    • They agree to support and assist you in the process of seeking employment opportunities in Tasmania once you arrive there.

Small Business Owner Category

If you are a business owner and satisfy the following requirements, you may seek nomination via this pathway.

    • You need to provide evidence to show that your solely owned business has been established and operated in Tasmania for at least 6 months.
    • You must prove that your business is highly likely to provide you a personal income that meets the minimum taxable income requirement set by Home Affairs for the subclass 191 Permanent Residence visa. Currently, the requirement is $53,900 per year for at least 3 years out of 5 years.
    • You need to provide a comprehensive business plan, which contains the following information:
      • evidence of conducting thorough research and understanding of the target market
      • understanding relevant industry conditions, licensing and/or registration requirements for the business in Tasmania
      • genuine growth opportunities for your business in Tasmania, especially where there are other existing competitive businesses already established in Tasmania.
