Subclass 461: New Zealand Citizen Family Relationship Visa

Subclass 461 New Zealand Citizen Family Relationship visa is a temporary visa to allow non-New Zealand citizen to live in Australia for 5 years, in each visa grant, with their member of family unit who is a New Zealand citizen holding a Subclass 444 Special Category visa or eligible for a Subclass 444 Special Category visa.

Stay Period

5 years from the visa grant date. After which, existing visa holder may apply for further Subclass 461 visa to continue living in Australia provided all eligibility criteria are met.

Apply from…

All applicants may be in or outside Australia, but not in immigration clearance, to apply for this visa and to be granted this visa.

However, if the applicant submit the application while

  • in Australia: the applicant must also be in Australia to be granted this visa; or
  • outside of Australia: the applicant must also be outside Australia to be granted this visa.

To make a valid application for Subclass 461 visa and/or be granted this visa, the following sets of criteria must be met:

Applicant is not a New Zealand Citizen

To apply, all applicants must not hold New Zealand citizenship.

Family Member of a New Zealand Citizen

To be eligible for this visa, the applicant must be a member of family unit of a New Zealand citizen, living in Australia on a Subclass 444 Special Category visa (usually applied for & processed upon arrival at the Australian airport) or will be coming to Australia with the applicant and will be granted a Subclass 444 visa upon arrival in Australia.

If you hold/recently held a Subclass 461 visa and you are no longer a member of family unit of that New Zealand citizen, you might be eligible to re-apply for this visa to extend your stay in Australia. Contact us for more details.

Any person who met the eligibility criteria outlined in “Eligibility Criteria” tab on this page can apply for this visa.

Each applicant in Australia when applying for this visa must:

  • hold a substantive temporary visa; and
  • not hold a Subclass 403 Temporary Work (International Relations) visa in the Domestic Worker (Diplomatic or Consular) stream.

The following condition(s) might be attached to this visa:

Condition 8303 – Not be disruptive or causing harm to the Australian community

Visa holder must not become involved in activities disruptive to, or violence threatening harm to, the Australian community or a group within the Australian community.

For example, engaging or promoting extremist views and interrupting the operation of the Australian community.

Condition 8501 – Maintain adequate health insurance

Visa holder must maintain adequate arrangements for health insurance while the holder is in Australia.
